Vivek Agarwal of Audittech 360 Residence Raided, Faces Criminal Investigation and 16 Years Imprisonment

Vivek Agarwal, the founder of Auditech 360 Management Consultants and the son of Chouthmal Agarwal, is also the co accused in the prominent case of Sunland Projects Pvt Ltd, a company currently under intense legal scrutiny. He, along with the co conspirators and other directors of the company, faces a criminal investigation following an FIR filed by Kolkata Police.


The FIR, lodged on December 22, 2023, at Rabindra Sarobar Police Station, accuses Amit
Gupta, the promoter of Sunland Projects, of engaging in a “fraudulent share transfer” of
1,510,000 shares, “forging and manipulating records,” and “illegally striking off” a loan of Rs 9,95,64,143 owed by Sunland Projects Pvt Ltd. The FIR also says that a co conspirator in the fraud is Vivek Agarwal.
As a co-accused, Vivek Agarwal has faced a police raid at his residence on GT Road in Howrah at 250A/10 GT Road. According to a detailed 18-page document issued by the Chief Judicial Magistrate of Alipore Police Court, the police were instructed “to seize and take possession of any forged documents, forged stamps & seals, computer-devices” and to ensure that “every part and portion of the office of the accused persons is searched thoroughly.”
Agarwal’s business history adds further complexity to the case. His former business partner at Auditech, Subhash Chand Khandelwal, was also a director at Sunland Projects Pvt Ltd. Currently, Pooja Agarwal has replaced Khandelwal as his business partner at Auditech.
Facing serious charges, Agarwal could be sentenced to up to 16 years in prison for his involvement in fraud, forgery, and financial record manipulation under the Indian Penal Code. However, as a conspirator, he may receive a lesser sentence if convicted.

Court documents from the Alipore case reveal significant procedural misconduct in the share transfer that involved 33.33% of Sunland’s total shares. The share transfer documents were missing the petitioner’s signature, lacked Public Notary registration, and the associated gift deed was not uploaded to the Ministry of Corporate Affairs website. The case has been filed with the National Company Law Tribunal (NCLT).
It is particularly surprising that Agarwal, who is described on Auditech’s official website as a
“CA, DISA, CIFRS & CTax-UAE with over 15 years of experience in managing & conducting Management & Forensic Audits at Birla Group,” would be implicated in a corporate criminal conspiracy. If convicted, these allegations could severely damage Agarwal’s professional reputation and career.


Moreover, Agarwal’s involvement with his firm, Auditech 360 Management Consultants, raises questions about the legitimacy of his business dealings, the sources of his income, and the individuals with whom he associates. These developments have cast a shadow on the integrity of his professional practices.
