Supreme Court Cancels Sonam Raghuvanshi’s Bail, Orders Surrender Within Three Weeks

New Delhi: The Supreme Court of India has cancelled the bail granted to Sonam Raghuvanshi, the prime accused in the widely discussed Raja Raghuvanshi murder case, directing her to surrender before the police within three weeks.

The order was passed by a Bench comprising Justice M.M. Sundresh and Justice P.B. Varale, which set aside the earlier bail granted by the lower courts after hearing an appeal filed by the Meghalaya Government.

Supreme Court Sets Aside Bail Order

The Meghalaya Government had challenged the High Court’s decision, arguing that bail had been granted based on an incorrect interpretation of legal provisions related to the arrest process.

After examining the case, the Supreme Court observed that although there was a technical error in the arrest documents, it was not sufficient to justify granting bail.

The Bench clarified that Article 22(1) of the Constitution requires an accused to be informed of the grounds of arrest. However, the court noted that this case could not be treated as one where the accused was completely unaware of the reasons for arrest.

According to the court, a technical mistake in documentation cannot automatically become a ground for bail if the overall legal procedure has substantially been followed.

Fresh Bail Possible After Six Months

While cancelling the bail, the Supreme Court also provided relief by observing that if the trial is not completed within six months, Sonam Raghuvanshi may file a fresh bail application before the competent court.

The court emphasized the need for a speedy trial while balancing the legal rights of the accused.

Background of the Raja Raghuvanshi Murder Case

According to the prosecution, Sonam Raghuvanshi allegedly conspired to murder her husband Raja Raghuvanshi during their honeymoon trip to Meghalaya shortly after their marriage.

Investigators claim Raja Raghuvanshi was allegedly killed, and his body was later recovered from a deep gorge in Meghalaya.

The prosecution has also alleged that three other accused were hired to execute the murder. These allegations are part of the prosecution’s case and are currently under trial before the competent court.
