Bihar Election 2025: Supreme Court Delivers a Major Blow to Election Commission Over Aadhaar Card

A major controversy has erupted in Bihar ahead of the 2025 assembly elections. The Supreme Court has dealt a significant blow to the Election Commission regarding the use of Aadhaar cards. This ruling could bring major changes to the electoral process in the state!

The court has clearly stated that Aadhaar must now be accepted as a valid identity document for including names in the voter list. However, it also issued a warning that Aadhaar cannot be used as proof of citizenship.

A two-judge bench comprising Justice Surya Kant and Justice Joymalya Bagchi gave strict directions to the Election Commission. The Commission has been instructed to issue clear guidelines to its officials to verify Aadhaar authenticity and accept it as a valid proof of identity. The court warned that excuses or delays will not be tolerated.

The Election Commission assured the court that Aadhaar will be accepted as an identity document. However, appearing on behalf of RJD, senior advocate Kapil Sibal strongly argued that Aadhaar is the most comprehensive document available, yet attempts are being made to exclude poor voters from the process. He presented affidavits from voters whose Aadhaar cards were rejected by authorities.

Election Commission representative Rakesh Dwivedi clarified that Aadhaar is not proof of citizenship but will be recognized for identity verification. The court added that among the 11 approved documents for voter inclusion, only the passport and birth certificate establish citizenship; none of the others prove it.
